The world was stunned on Friday when the Hollywood star Alec Baldwin’s involuntary manslaughter case was dismissed. He had been on trial for the 2021 death of the cinematographer Halyna Hutchins on the set of his movie Rust.

Rust armorer Hannah Guttierez-Reed is currently serving 18 months in prison for Hutchins death. But with this new turn of events, she’s now demanding a new trial.

Gutierrez-Reed Demands New Trial

On Tuesday, Gutierrez-Reed’s lawyers filed an expedited motion calling for either a new trial or her case to be dismissed.

“Following the Baldwin trial and the dismissal with prejudice, Ms. Gutierrez-Reed intends to file an expedited motion for new trial or for dismissal for discovery violations and under the court’s inherent power,” read court documents obtained by Fox News.

Gutierrez-Reed’s lawyers went on to argue that “Baldwin’s trial exposes extreme misconduct.” They later added that “Special Prosecutor Kari Morrissey lies to this court under oath.” 

Guiterrez-Reed was found guilty of involuntary manslaughter for Hutchins’ death back in March. She had been responsible for the gun that Baldwin was holding when it went off. The weapon took the life of Hutchins and injured director Joel Souza.

Baldwin Case Dismissed

Baldwin had been on trial for the same charge. However, Mary Marlowe Sommer dismissed the case against him last Friday. She did this after finding that the prosecution concealed evidence from his legal team.

“The state’s willful withholding of this information was intentional and deliberate,” Judge Sommer said. “If this conduct does not rise to the level of bad faith, it certainly comes so near to bad faith as to show signs of scorching prejudice.”

“There is no way for the court to right this wrong,” she added.

Judge Sommer dismissed the case with prejudice. This means that the charge can’t be brought against Baldwin again. Baldwin could not help but break down in tears as she dismissed the case against him.

Guitierrez-Reed’s attorneys pointed out that “the same prosecutor and same sheriff’s office that handled the Gutierrez Reed case.” 

The documents also said that the additional testimony in Baldwin’s trial was “new and different and would have been critical to cross examination” of PDQ Props owner Seth Kenney.

On top of that, Gutierrez-Reed’s lawyers became aware of “another possible 900 or so pages of material.” This material was related to state witnesses that had not been disclosed to the defense, but had been provided to Baldwin’s attorneys.

‘Devastating’ Impact On Gutierrez-Reed’s Life

Gutierrez-Reed’s lawyer Jason Bowles has alleged that the Rust shooting occurred because of factors on the movie set that were out of her control.

“Whoever put the live round on set and then Mr. Baldwin, in the end, going off script and doing what he did,” Bowles said. “Those are outside events outside of Ms. Gutierrez Reed’s control that she didn’t know was going to happen.”

Bowles told Variety that the impact that this has all had on Gutierrez-Reed “has been devastating.”

“She now sits in state prison serving an 18-month sentence based on what we now know was a proceeding that was rendered unfair and unconstitutional by the State’s conduct,” he said. “This Court should not countenance the State’s deplorable behavior.”

At the time of this writing, the court has yet to respond to Gutierrez-Reed’s request.
